I have significant experience in the areas of areas of personal injury, product liability, worker’s compensation and general litigation. For example, I participated on behalf of a plaintiff in a personal injury trial that resulted in a then record Winnebago County verdict of $5.85 million. I recently defended a product liability client in federal court that resulted in a two week jury trial. The plaintiff’s attorney asked the jury for $10 million dollars in compensatory damages. The jury came back with a complete defense verdict. I have also settled a wrongful death matter on behalf of a decedent’s estate for $2.5 million involving a negligent over the road trucker and obtained a $650,000 settlement which is one of the largest local slip and fall settlements in the area..
In terms of worker’s compensation, recently I obtained an $80,000 lump sum settlement for a client that died of lung cancer while working in the chemical mixing department of a Freeport manufacturer. I also recently obtained a $110,000 lump sum settlement for a client suffering from reflex sympathetic dystrophy that resulted from a relatively minor knee injury while working for another manufacturer in Sterling. Recently, I have taken to hearing cases involving a truck driver with a fused wrist and municipal street department worker with torn knee cartilage and obtained awards for permanent partial disability benefits significantly in excess of the amounts offered in settlement by the employers.
Regarding general litigation, I have experience, for example, in such areas as contracts, mechanics liens, insurance and disability policies (including claims for uninsured and underinsured motorist benefits), drafting of wills and powers of attorney and probating estates, including will challenges. In these areas, I have litigated such cases to verdict, for example, involving foreclosure of a mechanics lien concerning work on demolished property and a breach of contract involving the promise to provide employee benefits. I have prosecuted, defended and served as an arbitrator through evidentiary hearing and decisions on numerous contractual claims for uninsured and underinsured motorists’ benefits.
I also have significant appellate practice with recent appeals to the Appellate Court of Illinois 2nd Judicial District involving a contract to provide employee health insurance and an appeal to the United States Court of Appeals, 7th Circuit involving the scope of a bankruptcy release and its effect on a pending state court breach of contract action. I am admitted to the federal district court trial bar and the federal courts of appeals for the 7th and 8th circuits.
